Terms of Service

 

Booking & Confirmation

Acceptance of the proposal and these terms, together with paying the booking fee constitutes a formal agreement.

Payment terms – A booking fee equivalent to 30% of your investment is due immediately to secure the date. The balance of payment is due 4 weeks prior to your wedding. Payment can be made in cash or bank transfer.

Amendments to booking – Amending the coverage and/or products after the booking fee has been paid is subject to availability. Your account balance will be adjusted accordingly.  If an adjustment results in a credit, any complimentary products or services will no longer apply and will be charged at the prices quoted in your proposal. 

Copyrights & Marketing

Copyright – Per the Copyright, Designs & Patents act 1988, copyright will always be the property of Ketan Amin, our photographers, assigns and heirs. Should your package include digital images, it’s implied that you’ll be given a license to use the images for non-commercial purposes. Original digital images (RAW files) are never released.

Use of images – We use the very best images, including yours, to promote our business. This includes but not limited to exhibitions, in print and online. Images may be used for whatever purposes the copyright law permits. If you wish to opt out, please let us know in writing to info@ketanamin.com.

Images

Style – Your portfolio will reflect our style of images seen online and in print, or wherever promoted. We will use our experience, skill and artistic discretion to create images as we see fit. We’re not held responsible for the subjective interpretation of photography.

Image quality – Despite using the latest professional grade gear and software, due to the nature of your event/s, it is not always possible to capture a specific image or pose nor produce satisfactory image quality. For example, smoke and haze machines, lazer lights, uncooperative suppliers and guests being uncooperative and/or making excessive use of their digital camera are likely to affect our efforts, quality and potentially cause delays. 

Image quantity and editing –  There is no limit to the number of images we deliver. After stripping out duplicate or simply unusable images, the rest will be edited for colour correction, tonal balancing, exposure correction and contrast adjustments. At the discretion of your photographer, a select few images will be enhanced further to produce that wow factor. Digital air-brushing, blemish removals or adding, removing or changing items in an image do not form part of our normal editing process. As advanced editing is outsourced, we’re happy to provide a quote on any exceptional requests.

Final images will be available via a download link with your final package and will be in high resolution jpeg files.

Products & Services

Complimentary products and services – These can’t be postponed, exchanged, transferred or redeemed for cash. Should you choose not to use them in a timely manor, then you will lose them.

Who will capture my events…Your photographer will be the person with whom you had your consultation unless otherwise agreed. For events other than the traditional wedding and reception, it may become necessary for a fellow photographer may capture those festivities. Naturally, you’ll be notified in advance. We make express guaranties that capture style and quality will never be compromised.

If required, would you stay longer than the contracted hours…Certainly! If there are important images still to capture, with your permission, we will stay until we’ve captured a comprehensive portfolio. Every hour over the contracted hours will be charged at £150. This balance needs to be settled prior to the release of any images.

What if I change my mind about the products or packages after the event…It happens more often than you will believe. You may certainly choose additional products and/or even upgrade an existing package. As a result, any outstanding balance needs to be settled at the time of choosing your final products

Album design & revisions… After receiving your proofs, you have 12 months to sign-off the final design of your album. After 12 months, there will be charge of £100 per book per year or part thereof. We will require 2 weeks to design the 1st draft and then at least 5 days for each set of change requests. You may request revisions up to three times. There is no limit to the number of edits per revision. After the initial 3 revisions, the cost is £50 per change. 

Cancellations & Liabilities

Limited liability – If for any reason we’re unable to perform any or all of the duties agreed on, including but not limited to, fire, transportation problems, acts of God, Government directives, accident, illness, theft, or technical problems, and if we cannot provide another competent professional, all money received by us, minus expenses or work already completed, will be returned to , and we shall have no further liability with respect to this agreement. This limitation of liability also applies to any loss/damage of photographs or failure to deliver photographs for any reason. Liability for a partial loss of photographs shall be pro-rated based on the percentage of total. The sole remedy for any actions or claims shall be limited to a refund where the total amount cannot exceed the total monies paid under this Agreement during the time preceding the date on which such liability arises.

Should you or anyone else present at the time encounter damage, experience loss, injury or death arising from our performance, our entire liability is limited to a refund of the amounts paid for our services. It is a good practice to seek out Wedding Insurance.

Should we sustain any damage to any of our equipment as a direct or indirect result of any of your guests or suppliers, invited or not, you will be liable for the repair or replacement cost of such equipment.

Client reschedule or cancellation – There is no cost to reschedule your date/s. Should you need to cancel your booking due to Government directives or laws, you will receive a full refund, less any costs incurred to date. Should you cancel for any other reason,  as compensation for loss of income, the following charges apply as a percentage of the total booking amount. (Number of days before the wedding day): 0-45 days = 100%, 46-90 days = 75%, 91-120 days = 50%.

Your responsibilities

Provide an itinerary for your events at least a week in advance of your events.

Provide contact details of people we can call on the day should the need arise.

Ensure that an appropriate parking space is reserved for us at each of the contracted events to avoid delays.

Ensure that you’ve compiled a group photo list and delegated it to someone capable of managing the groups.

Ensure all deposits and balances are settled in time.

Completion & Collection

Completion of agreement…Once you’ve signed off the final design, your book together with any other outstanding products will be ready for collection 4-5 weeks later. Under special circumstances, delivery is availble at £26,50 to cover packaging, postage and insurance.

Governing Law

This agreement shall be governed in accordance with the laws of England and Wales.
